Sale of disposable bed linen, semi-durable bed equipment, disposable bathroom linen, in Metropolitan France.

Any order for a product offered on the website implies that the general terms and conditions of sale have been brought to the attention of the buyer, which they validate through their purchase order (value of "Digital Signature").

All products offered by KIT LINGE FRANCE are presented on the website www.kit-linge.com. They are aimed at tourism professionals and individuals.

A description and photos define the product. They are for indicative purposes only and are not part of the contractual scope. In case of error, KIT LINGE FRANCE cannot be held liable.

Only the essential characteristics of the product are indicated on our website.

Information is provided on the packaging and must be read. In addition, KIT LINGE FRANCE is available to customers to answer specific questions.

Article 1. General Provisions

These general terms and conditions of sale (hereinafter the "GTC") apply, without restriction or reservation, to all sales concluded by the company Kit Linge France (as defined in the Legal Notice) with customers holding an account opened with the Company (hereinafter "Customer(s)"), wishing to acquire the products offered for sale by the Company (hereinafter "Product(s)") on the website www.kit-linge.com (hereinafter the "Site") as well as to any sale made remotely by any electronic communication means. They specify in particular the conditions for ordering, payment, delivery, and management of any returns of Products ordered by Customers.

The Customer acknowledges having the required capacity to commit to and acquire the Products offered on the Site. These GTC apply to any order placed by a Customer on the Site.
They may be supplemented if necessary by special conditions of sale, which prevail over all other conditions, unless expressly agreed otherwise in writing between the Seller and the Customer.

The Customer declares to have read the GTC and to have fully accepted them by checking the box provided for this purpose before validating the online order. As the GTC may be subject to subsequent modifications, the version applicable to the Customer's order is the one in force on the Site on the date of its placement.

Unless proven otherwise, the data recorded in the Company's computer system constitutes proof of all transactions concluded with the Customer.

The Company reserves the right not to fulfill a Customer's order in the event of non-compliance by the latter with these GTC or an exorbitant and/or abnormal request.

The fact that the Company does not invoke, at a given time, any clause of these GTC shall in no way be considered as a waiver by the Company of the rights arising from said clause.
Furthermore, the cancellation of any of the provisions hereof, for whatever reason, does not entail the cancellation of the other provisions of the GTC.

Article 2. Products

2.1. Product Characteristics

The list of Products presented on the Site may evolve at any time to better meet the Customer's needs.

The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacity, are presented on the Site and may be modified at any time.

The Customer is required to refer to the description of each Product to ascertain its essential properties and particularities. The Customer is responsible for reviewing this information before placing any order, as the choice and purchase of a Product are solely the Customer's responsibility.

The storage and installation of products containing wood require controlling the humidity of the atmosphere, the support, and the product.

2.2. Use of Products

Before using the Product, the Customer ensures that precautions for use are applied: storage of disposable linen in a clean and dry place, protected from dust.

2.3. Compliance with Legal and Regulatory Provisions – Export

The Products comply with the legal and regulatory provisions applicable in France.

It is the Customer's responsibility, and theirs alone, to verify the conformity of the Product in case of export or use of the Product outside France.

Article 3. Product Prices

The selling prices of the Products are those displayed on the Site at the time of the order. Any price change subsequent to the order has no effect on it.

In case of a price difference between the Site and any other communication medium of the Company, the applicable price is the one indicated on the Site. The prices of the Products accessible on the Site are expressed in euros (€) all taxes included (T.T.C), displayed in bold and black characters, orange for the corresponding ex-tax price, at the current VAT rate.

Product prices do not include delivery charges. These charges are communicated to the Customer before the validation of their order and appear on the order summary received by e-mail, as well as on the invoice.

The selling prices of products may be changed at any time on the Site. Prices may be revised in particular based on the evolution of our commercial policy, variations resulting from labor costs, raw material prices, and transport costs.

Webmaster Development Bug

After notifying the customer, Kit Linge France reserves the right to correct any order containing an error due to a development bug on the site. In the event of a typographical error in the price of a Product on the Site, or a clearly erroneous or ridiculously low price, the Company will inform the concerned Customers of the said error and may cancel the order for the Product(s). The order will then be corrected to its fair price and will be subject to a new invoice.

Article 4. Order

4.1. Prior Creation of a Customer Account

The Customer wishing to place an order creates their own access (hereinafter the "Access") in the area provided for this purpose on the Site.

The Customer undertakes to make any necessary modifications to the information provided during the creation of their Access and to immediately inform the Company if they have reason to believe that their password and/or Personal Space are being used fraudulently by an unauthorized third party.

For any new order, the Customer goes to the Site and enters their username and password to place an order. In case of loss or忘记 (forgotten) password, the Customer can, by clicking on the 'forgot password' link, automatically receive an email allowing them to regenerate their password.

4.2. Placing an Order

The Customer places an order by following the instructions provided on the Site.

The ordering process involves several steps:

• the Customer fills their shopping cart with products and validates it, according to the instructions provided on the Site,
• the Customer indicates the desired delivery date, within a limit of 20 days from the order placement,
• the Customer confirms their contact details, ensuring that the necessary, accurate, and complete information is provided, particularly concerning the delivery address of the products, the access code for an entrance door if applicable, or any other specific detail useful for smooth delivery.

• The Customer proceeds to payment.

The Customer ensures that they have provided, under their responsibility, the accurate and complete information required, particularly concerning the delivery address and billing address. The Company cannot be held responsible for any entry errors and the consequences that may result. The Company reserves the right to charge the Customer for costs related to re-shipping or re-presenting the Product(s) resulting from incorrect information provided by the Customer.

The Customer has the possibility to modify their order at any time before its final validation (with payment obligation).

The Customer validates their order by clicking on the "Confirm" button.

The Company sends an order confirmation by e-mail to the Customer, detailing the terms of their order and an order number to the e-mail address provided by the Customer.

The order validation e-mail signifies the acceptance of the Customer's Order and thus forms the sales contract between the parties.

Archiving and right of access:

Communications between customers and KIT LINGE FRANCE are stored in the computer system and constitute proof of orders, payments, or any other relational exchange. This data is kept for 10 years, and the customer has a right of access to it.

Protection of personal data

All data you entrust to us is for the purpose of processing orders and offering targeted promotions.

In accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files and freedoms, the customer has the right to rectify, consult, modify, and delete data communicated to the seller. This right can also be exercised online, via the "manage my account" tab.

Article 5. Payment

All products are payable in full, upon order and in Euros. The order then becomes firm and final, and an automatic acknowledgment of receipt is sent.

Payment is made:

• Either by credit card on our doubly secure CIC website
• Or by PayPal, secure account

Regardless of the payment method, the order will only be confirmed after receipt of payment.

Article 6. Delivery

6.1.1 Delivery charges in Metropolitan France – EXCLUDING CORSICA

Shipment will be made by GLS carrier. The calculation of the shipping cost contribution is based on the order amount according to the rates offered below:

• from €0.01 to €15.00 = €8.40 incl. VAT
• from €15.01 to €35.00 = €13.20 incl. VAT
• from €35.01 to €75.00 = €16.80 incl. VAT
• from €75.01 to €110.00 = €18.90 incl. VAT
• from €110.01 to €140.00 = €20.40 incl. VAT
• from €140.01 to €174.99 = €22.20 incl. VAT
• FREE SHIPPING for goods worth €175 excl. VAT, i.e., €210 incl. VAT

6.1.2 Delivery charges in CORSICA

Shipping will be handled by GLS or by La Poste via Colissimo, depending on the weight and volume of the parcel(s). The calculation of the shipping cost contribution is based on the order amount, according to the rates offered below:

• from €0.01 to €25.00 = €10.80 incl. VAT
• from €25.01 to €75.00 = €15.00 incl. VAT
• from €75.01 to €130.00 = €21.60 incl. VAT
• from €130.01 to €200.00 = €30.00 incl. VAT
• from €200.01 to €300.00 = €32.00 incl. VAT
• from €300.01 to €400.00 = €54.00 incl. VAT
• from €400.01 to €499.99 = €66.00 incl. VAT
• FREE SHIPPING for goods worth €500 excl. VAT, i.e. €600 incl. VAT

6.2. Delivery times in Metropolitan France –

Orders are delivered within 2 to 3 working days upon receipt of payment for the order, excluding Corsica and islands.

Delivery to Corsica: 5 to 7 working days upon receipt of order payment.

Delivery is made to the address specified by the Customer when placing their order.

The delivery address must be located in metropolitan France (excluding Corsica) only and must be accessible, particularly by a passable road, without danger or risk to the carrier.

The Company reserves the right to refuse delivery of Products in certain areas difficult for the carrier to access (mountains, islands, etc.). The Company disclaims all liability if any damage occurs at the delivery location due to difficult access or unsuitable terrain.

In case of apparent anomaly, it will be up to the Customer to:

• precisely describe the condition of the Products on the delivery note
• have any reservations co-signed by the carrier,
• photos of packages before unpacking
• within 48 hours of delivery, inform the Company by contacting them in writing via their contact form

The Company will communicate its agreement or refusal regarding the return request for the Products to the Customer as soon as possible.

In the absence of precise and justified reservations, delivery will be considered compliant with the order, releasing the Company and the carrier from their delivery obligations, without prejudice to the subsequent application, if applicable, of conventional or legal guarantees.

In the event that delivery to the address indicated by the Customer is not possible (e.g., input error in the delivery address, not living at the indicated address, etc.), the Customer will contact the Company to jointly redefine the terms of making their order available.

Failing new information received from the Customer within forty-five (45) calendar days after the 1st presentation of the delivery to the address initially indicated by them when placing their order, the Company may freely dispose of any undelivered Product and retain the amount paid at the time of the order, without prejudice to any applicable penalties.

6.3. Delivery error

In case of a delivery error due to the carrier, the Customer will have the possibility to contact Kit Linge France to inform them of the observed discrepancy and to file a complaint if necessary. Kit Linge France will initiate a search for the parcel(s) with the Transport Company.

In case of non-compliance with the ordered product reference or an apparent proven non-conformity, the Customer may return the product concerned to Kit Linge France, who will arrange for a carrier to pick up the product at the delivery location. Return shipping costs are borne by the Seller if prior agreement has been given.

Article 7. Right of Withdrawal – Product Returns

Professional clients do not benefit from a right of withdrawal.

Withdrawal period:

For any order placed on the Site, the consumer Customer has, in application of Article L.221-18 of the Consumer Code, a withdrawal period of fourteen (14) days from the delivery of the Products to the Customer following their delivery or collection.

By exception, the Customer does not have a right of withdrawal:

• For goods manufactured to their specifications or clearly personalized
• For goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection
• When the Products, after being received and by their nature, are mixed with other products.

Terms of exercise and effects of the right of withdrawal:

The Customer may exercise their right of withdrawal by writing to Kit Linge France via their contact form.

Within a maximum period of fourteen (14) days from the communication of their decision to withdraw to the Company, the Customer must reship or return the Products. These must be returned in their perfect original condition, accompanied by all possible accessories, instructions for use, and documentation. Return costs are borne by the Customer.

Return of goods:

Returns of goods are only accepted if we have authorized them beforehand. They must reach us free of all charges in their original packaging and only concern goods in perfect and/or new condition.

In the event of an accepted order cancellation by our company, returned goods are credited to the customer without them being able to demand a refund. This return can only result in a credit note for the purchase of other goods, unless formally validated by the management of our Company.

Force majeure:

Our Company's obligations will be automatically and formally suspended, and our liability disengaged, particularly in the event of events, whether or not they have the legal character of force majeure or an act of God, such as:

• fire
• any work stoppage in our Company or at its suppliers
• lockout
• flood
• epidemic
• war
• terrorist attack
• requisition
• strike
• hurricane
• tornado
• tsunami
• earthquake
• theft of all or part of the equipment
• frost
• lack of raw materials
• tooling accident
• lack of fuel or electrical energy
• interruption or delay in transport
• impossibility or difficulty of import or export
• as well as in the event of any circumstances occurring after the conclusion of the sales contract and preventing its execution under normal conditions by our Company.

Our Company will inform the Customer as soon as possible of the occurrence of one of the events listed above and will endeavor to mitigate its effects as quickly as possible.

Article 8. Jurisdiction

These conditions are subject to French law.

Any dispute relating to sales will, in the absence of an amicable agreement, fall under the exclusive jurisdiction of the Courts where our Company's registered office is located. The Commercial Court will be solely competent in the event of a dispute.
